Student Harassment and Sexual Misconduct

This webpage summarises the College’s policy and procedures on student harassment and sexual misconduct, including intimate personal relationships between staff members and students*.

1. Introduction

Askham Bryan College is committed to providing a safe and inclusive environment that helps to promote wellbeing and success regardless of background.

We aim to create a safe and inclusive environment where everyone is treated fairly and with respect. We believe that acts of harassment, sexual misconduct and violence are unacceptable. Harassment and sexual misconduct are not tolerated at Askham Bryan College, and any allegations will be taken seriously, considered carefully, and acted upon appropriately.

What is harassment?

Includes any unwanted behaviour 10:03:20or conduct which intends to violate a person’s dignity, or create an intimidating, hostile, humiliating or offensive environment due to any of the following protected characteristics:
• Age
• Disability
• Gender reassignment
• Race
• Religion or belief
• Sex
• Sexual orientation

Harassment also includes:
  • Incidents of physical violence towards a person due to a protected characteristic
  • Hate crimes perceived to be motivated by prejudice or hostility
  • Stalking, domestic abuse and violence (which involves coercion, control, and/or threats)
What is sexual misconduct?

Sexual misconduct relates to all unwanted conduct of a sexual nature. This includes but is not limited to:

  • Sexual harassment
  • Unwanted physical sexual advances
  • Assault and/or rape
  • Intimidation, or promising resources or benefits in return for sexual favours
  • Distributing personal and private explicit images or video footage of an individual without their explicit consent

2. Policies

Our policies align to the principles of creating an inclusive and respectful environment, identifying sources of support, and ensuring decisions are made which are credible and fair.

Confidentiality is protected where appropriate, potential risks are assessed and mitigated, investigations are undertaken by appropriately trained staff and persons affected by decisions are informed in an appropriate manner.

The policy followed by the College will be the version current at time of an incident being reported (rather than at time incident occurred, should there be a delay between occurrence and reporting of incident).

In addressing instances of harassment and sexual misconduct, the College follows its established procedures for investigation and disciplinary matters as per the appropriate policies.

In order to maintain professional relationships with students, the College prohibits intimate personal relationships between staff and students, with the exception of pre-existing consensual relationships where the student is over 18, which must be declared to the staff member’s line manager, Executive Director of People Services and Organisational Development and any conflict of interest reported to relevant assessment board(s), as appropriate.

Examples of permitted relationships are:
  • consensual and intimate relationships established before the staff member became a member of staff at the College,
  • or between the staff member and the student before they became a student at the College and where the student was over 16 at the time.

3. How to report an incident?

If current students have experienced an act of sexual misconduct, violence, harassment or hate, whether on campus, in halls or private residence, or in daily life, they can use our online reporting tool, to report an incident (Askham Bryan Whisper Form).

Students can report anonymously if they wish to. If they choose to report with contact details, a member of the Student Services will contact them to provide advice and support and help them explore options.

Students can provide as much or as little information as they feel comfortable with. Reports can be about an individual, a group of people, or a particular culture they have experienced. Allegations will be taken seriously, considered carefully, and acted upon appropriately. (Please note that if a student chooses to report anonymously, the College will be unable to take any action, nor provide any advice. However, the information will still be used to monitor issues across Askham Bryan College).

 

Students may also choose to disclose an issue or incident to a staff member, who will then have a duty to report the issue to the relevant internal support services as per the College policy. Whether students choose to report online or directly to a member of staff, the information is collected sensitively and treated with appropriate confidentiality.

These procedures should not stop or delay any report to the police. To report a crime in an emergency dial 999, for the reporting of non-emergency incidents dial 101 or report anonymously via Crime Stoppers 0800 555 111.

When a student reports an incident relating to harassment and/or sexual misconduct, the College has not, and will not, impose any non-disclosure restrictions upon them. We do, however, encourage students to access appropriate support regarding any incidents (see Section 5. Getting Support).

 

If a student reports an issue directly to a staff member that staff member should follow standard safeguarding reporting mechanisms.

4. Preventing Harassment and Sexual Misconduct

All new students are expected to undertake an awareness/training session to ensure they understand what constitutes harassment and sexual misconduct including understanding consent.

All students will be made aware of how they can report incidents to the College, what the College would do to address such issues and what support is available for any student affected.

All residential students receive a welcome information during their first week which covers issues related to rules about halls living (including fire safety, anti-social behaviour, drug abuse, etc.) as well as further information related campus behaviour and where to report issues of harassment and misconduct.

All new and returning students will be alerted to this single comprehensive source of information which identifies all relevant guidance, policies, and support in relation to harassment and sexual misconduct.

All students agree to abide by the College’s Student Code of Conduct, which outlines expected behaviours with regards to a range of themes and issues.

Exemptions to training

The College is committed to providing a safe and inclusive environment that helps to promote wellbeing and success regardless of background. We believe that acts of sexual misconduct and violence are unacceptable.

It is important that all of our students have awareness and training around harassment and misconduct, however, we recognise that personal circumstances may mean engaging with this subject matter is particularly difficult for certain students due to their own previous experiences. Students can contact Student Services or their Course Manager to express their preference to be exempt from this training and to ensure they are accessing appropriate support.

All staff are required to undertake harassment and sexual misconduct awareness training to help identify, address, remove and prevent harassment.

All staff receive information on how to signpost students to sources of support and how to report incidents of harassment and sexual misconduct to the College (including guiding staff to this comprehensive source of information).

Front line staff supporting those who disclose issues will receive targeted training.
Staff involved in Investigating any reported issues and disciplinary panel members will receive training on the College policies and procedures in relation to harassment and sexual misconduct and will ensure cases are managed appropriately with due regard to all parties involved.

All staff will be alerted to this single comprehensive source of information which identifies all relevant guidance, policies, and support in relation to harassment and sexual misconduct.

5. Getting Support

Students can access support for harassment and/or sexual misconduct in a variety of different ways, depending on what they feel most comfortable. These can be accessed through Student Services, including well-being support and guidance – Student Services | Askham Bryan College.

We support students:

  • Regardless of whether the incident has happened on or off campus
  • Whether they wish to take informal or formal action, or no action at all
  • To report to the Police if they wish
  • To link in with other expert assistance (such as the local Sexual Assault Referral Centre)
  • With their studies: Support is provided to ensure the continued academic engagement of any student involved in an investigation, or similar process, where a student wishes to continue studying. Academic and/or assessment arrangements may be changed as appropriate during such a process in line with the relevant Mitigating Circumstances policies.
